Transfers Suspended Until Rule Resolved: NTRCA-Recommended Madrasa and Technical Teachers Seek Court Compliance

Non-government index-holding teachers have sent a lawyer's certificate to the Ministry of Education and related departments, demanding suspension of transfers for NTRCA-recommended madrasa and technical educators until a pending High Court rule is resolved.
The certificate, issued by Advocate Zakir Hossain on behalf of the petitioners, argues that proceeding with transfers could undermine the judicial process and independence.
On August 2, 132 NTRCA-recommended teachers from madrasas and technical institutions filed a writ petition challenging the transfer policy as unconstitutional.
The petition claims the policy violates existing MPO guidelines—Section 12 for madrasas and Section 23.3 for technical education—leading to discrimination among teachers.
After a preliminary hearing, the High Court issued a rule on August 11, directing respondents to explain why the policy should not be declared unconstitutional and what orders the court could issue.
The petitioners contend that ongoing transfers, despite the rule, contradict the court's proceedings and could prejudice the outcome.
This legal move comes amid broader concerns over teacher mobility and equity in Bangladesh's non-government education sector, where over 60,000 posts remain vacant.
The Education Ministry and NTRCA have yet to respond to the certificate.
